在外租房一年多，被骗去房产的老人终于回了家

针对老年人特别注重养生而风险防范能力又弱的特点，一些涉嫌“套路贷”的诈骗分子专门打起了老年人的主意。央视新闻曾经报道过一对80多岁的退休老人，在高额回报的诱惑下，将仅有的房子做了抵押购买保健品，最终只能租房过日子的事情。详情>>>
就在今年的7月23日，事情有了结果：北京法院的法官和法警依法强制执行，将房子归还给了两位老人。

八旬老人在外租房一年多后 终可归家
接到法院的强制执行通知后，已经在外租房居住了一年零四个月的张光兴、刘曙光老人在律师的陪同下，在许久没回过的自家楼下，等候执行法官的到来。

北京丰台法院的执行法官和法警到达后，立刻开始了强制执行。在法官和法警的监督下，被强制执行人杨世军打开了房门。
一个多小时后，强制执行结束，房子顺利交还给了两位老人。

北京市丰台区人民法院执行法官 田硕宁：丰台区不动产登记中心在做协调，准备做强制过户手续。把这个房子重新强制过户到张光兴老人名下，并且房子的抵押也要强制解除。

以房抵押 贷款投资保健品掉陷阱
张光兴老人今年已经86岁，在外颠沛流离一年多之后，重新回到自己家中，百感交集。
2016年12月，张光兴老人抵押房子向借贷公司贷款300万，进行了所谓的“投资”。根据合同规定，张光兴老人不仅可以免费吃保健品，每个月还可以获得6万的回购款以及300万贷款的利息，每个月9万元。于是，当放贷公司在2017年4月提出可以再给老人贷款100万时，老人就答应了，并且还跟着保健品公司和贷款公司的人去公证处，做了房屋抵押公证手续。
可到了2018年4月的一天，突然有人敲张光兴老人的房门，说房子是他们的了。新的房产证显示，老人的这套房子已经是一个叫丁明的人的了。
张光兴老人的房子，怎么会被别人卖掉呢？律师发现，问题就出在他们第二次办100万贷款的时候。原来，张光兴老人在北京方正公证处签下的这份委托书上显示：受托人可以代我们到房地产交易管理部门办理房产产权转移、过户事宜等。受托人就是放贷公司的杨世军。
对于这份自己签了名的委托书，两位老人表示当时是听信了他人说辞，就是履行个公证手续，然后就可以贷到款免费吃保健品了；至于签署了这些公证文件意味着什么，他们完全稀里糊涂。
2017年12月，在老人完全不知情的情况下，房子被贷款公司的杨世军以低于市场价约200万卖掉。
虚假交易 法院判定卖房合同无效老人的房子已被小贷公司的人员强行卖掉，那法院将房子判还给老人的依据是什么呢？
北京市丰台区人民法院审理后发现，张光兴、刘曙光老人房子的买受人丁明，实际上并没有付款。丁明也在法庭上承认，房子并不是自己花钱买的，而因为自己是北京户口，来替杨世军来代为持有这个房产。

法院审理后认为，代理人不得以被代理人的名义，与自己实施民事法律行为。张光兴委托杨世军出售房屋，丁明作为购房人是代杨世军持有房屋，本质上是杨世军与自己签订合同。故此《房屋买卖合同》属于无效。最后判令被告丁明、杨世军于判决生效后十日内将房屋交还给张光兴老人。

一审判决后，被告杨世军不服，向北京市第二中级人民法院提起上诉。今年4月，北京二中院作出终审判决，驳回了杨世军的上诉，维持一审判决。
多部门联手 斩断围猎老人的“黑手”
针对花样繁多的“套路贷”犯罪，今年4月，最高人民法院、最高人民检察院、公安部、司法部出台了《关于办理“套路贷”刑事案件若干问题的意见》，界定了“套路贷”和民间借贷的区别，指出：“套路贷”是对以非法占有为目的，假借民间借贷之名，诱使或迫使被害人签订“借贷”或变相“借贷”“抵押”“担保”等相关协议，并借助诉讼、仲裁、公证或者采用暴力、威胁以及其他手段非法占有被害人财物的相关违法犯罪活动。

四部委出台的《关于办理“套路贷”刑事案件若干问题的意见》还明确规定，以老年人为对象实施“套路贷”的，应从重处罚。

专家建议，根据《意见》精神，司法机关在打击涉“套路贷”犯罪时，如果以公司形式犯罪的，在对公司依法惩处的同时，还要对公司的法定代表人，背后的实际控制人等依法追究刑事责任，有共同犯罪、甚至涉嫌黑恶势力犯罪的更应一并从严惩处。
